Is this what happened? As soon as he exited his vehicle he drew his gun and fired (whether intentional or unintentional) and it just happened to hit the kid?
If he's claiming ND, that's an incredibly unlucky shot.
From the reports the kid pulled his car into the garage, the deputy exited his vehicle and fired a round off.
Unless the kid had flashed a weapon or given reason for extreme violence , exiting a car with gun drawn is a big no no. At least in the department I work for. Hell, I draw my service weapon, my body cam comes on and dispatch is notified.
Not trying to split hairs. When you say exiting with gun drawn, do you mean drawing while still sitting in the vehicle and then trying to exit while holding your gun? I feel like there are tons of videos where officers draw as soon as they stand up out of the car, especially during felony stops, so I'm assuming that's not what you mean.
Out of curiosity, does your body cam come on automatically through a sensor? Or are you just saying you turn it on as soon as you draw? If the latter, that would seem to be less than ideal.
Sensor inside my holster that triggers "no pun intended" the body cam to go on. Which then sends an alert to dispatch that I've drawn my weapon. From reports, as soon as the officer existed the car within seconds a shot was fired. I can only assume, he had his hand on the weapon and was drawing as he exited the car.
You are right about felony stops and I've had my gun drawn out ready to go during those times. This "person" later to find out a kid, who yes drove about 2 miles to his house. Yet the officer didn't call in backup or from what we know, report pursuit on the radio. Since the deputy arrived at the house by himself and no backup.
How serious of a threat was the "person" later kid, in the middle of all this. I'm assuming the officer ran the plates and if the plates came back with warrants, why not call for backup. If the plates came back clean, why have your weapon drawn when exiting the car.
Either way, the deputy made so many wrong decisions that night, that took the life a young man, has ruined his own life and the community as a whole.
